A trademark is more than just the name under which you do business. Your trademark IS your business. A trademark is your brand, the way that consumers identify that your product goods or services comes from you.

Since a trademark owner is required to conduct a diligent search before they begin using their mark, whenever possible we help our clients to select marks that are less likely to result in disputes. We conduct trademark searches and provide you with our opinion regarding your ability to use and register your chosen mark with the U.S. Patent and Trademark Office (USPTO) or the State of Florida. We also file trademark, trade dress, trade name, and service mark applications with the USPTO and the State of Florida, and file Appeals with the Trademark Trial and Appeal Board (TTAB) once a final Office Action is received. Additionally, We help you manage your trademark registrations so that your investment in your mark is protected as long as you use it.

While we do our best to prevent litigation, when required to do so we also litigate and defend trademark infringement claims, trademark oppositions and cancellations.

Should you choose to let others use your mark for any reason, we will assist you by drafting trademark licenses and trademark usage guidelines.

When trademark disputes occur, we also represent clients in both Opposition and Cancellation proceedings before the TTAB. We draft cease and desist letters to others using our clients’ marks, and respond to demands received by our clients. We negotiate settlements on behalf of our clients and draft settlement agreements. And if need be, we represent trademark owners as well as those accused of trademark infringement in litigation.
